Acceptance and authority
These Terms of Use (“Terms”) apply to empirescba.com and related pages operated by Empire SCBA & Supplies (“Empire SCBA,” “we,” “us” or “our”). By accessing or using the Site, you agree to these Terms. These Terms should be read together with our Privacy Policy. If you use the Site for an organization, you confirm that you are authorized to act for that organization.
If you do not agree, do not use the Site. These Terms govern the Site only. A separate written quote, purchase order accepted by Empire SCBA, invoice, sale agreement, rental agreement or other transaction document may contain additional terms that govern a particular transaction.
Site purpose and quote requests
The Site provides general information about SCBA equipment, cylinders, accessories, extinguishers, testing information and possible rental options. It does not provide an online checkout and does not itself complete a purchase, rental or service engagement.
Submitting a contact or quote form is a request for information only. It is not an order, acceptance, reservation or binding offer by either party. A transaction exists only after Empire SCBA provides written acceptance and the parties agree to the applicable product, condition, configuration, quantity, currency, price, taxes, freight, delivery, payment and other transaction terms.
Catalog information, pricing and availability
We work to keep product titles, descriptions, images, condition information, prices and availability accurate. Inventory changes frequently, and website information may contain delays, omissions or typographical errors. Unless a written quote expressly states otherwise:
- availability and lead times require confirmation and inventory is not reserved;
- displayed prices are starting or informational prices in the currency shown;
- taxes, freight, duties, brokerage, installation, inspection and other charges are additional where applicable;
- product images may be representative, and included accessories or configuration require confirmation; and
- a written quote is valid only for its stated period and controls over conflicting website information.
We will not substitute materially different equipment without customer approval. Contact us before relying on a listed certification, manufacture date, service status, compatibility, condition or included component.
Life-safety equipment and professional responsibility
Website content is general product information only. It is not a substitute for a workplace hazard assessment, current manufacturer specifications and instructions, equipment approval verification, fit testing, training, inspection, maintenance, competent technical advice or compliance with applicable laws and standards.
Purchasers, renters and employers are responsible for selecting and using equipment through appropriately qualified personnel and for confirming that the final product, configuration and documentation meet their intended application and jurisdictional requirements. Equipment must be inspected, tested, maintained, stored and used in accordance with applicable law, standards and manufacturer requirements before being placed in service.
Nothing in these Terms limits a statutory duty, warranty, remedy or liability that cannot lawfully be excluded. Any product-specific warranty, return right or service commitment is stated in the applicable written transaction documents.
Acceptable use
You may use the Site for lawful personal or business information and purchasing activities. You must not:
- submit false, misleading, unlawful or infringing material;
- impersonate another person or misrepresent authority to act for an organization;
- introduce malicious code, interfere with operation or impose an unreasonable load;
- probe, bypass or attempt to defeat authentication, access controls or security measures;
- access a restricted administrator area without authorization; or
- use automated extraction in a manner that disrupts the Site or republishes a substantial part of its catalog without permission.
Ordinary search-engine indexing and accessibility tools are not prohibited by this section.
Intellectual property and trademarks
The Site’s original text, layout, graphics, software and Empire SCBA branding are owned by or licensed to Empire SCBA and are protected by applicable intellectual-property laws. We grant you a limited, revocable, non-exclusive right to view and use the Site for its intended informational and business purposes.
Manufacturer names, product names, logos and trademarks belong to their respective owners. Their appearance identifies compatible or available products and does not imply sponsorship unless expressly stated.
Third-party links and services
The Site may link to or offer user-initiated access to manufacturer information, maps, social networks or other third-party services. We do not control those services and are not responsible for their availability, content or privacy practices. A link does not necessarily imply endorsement.
Website availability and disclaimers
We may correct, update, suspend or discontinue Site content or functionality without notice. We do not guarantee uninterrupted, error-free or completely secure access.
To the extent permitted by law, the Site and its general informational content are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose or non-infringement. This website disclaimer does not replace or reduce an express commitment in a written transaction document and does not exclude rights that applicable law does not permit us to exclude.
Limitation for use of the Site
To the extent permitted by law, Empire SCBA is not liable for indirect, incidental, special or consequential loss arising solely from access to, inability to access or reliance on general website content. This limitation does not apply to a liability that cannot lawfully be limited and does not determine liability arising from a separately accepted product sale, rental or service transaction.
Governing law
These Terms and disputes concerning use of the Site are governed by the laws of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles. Subject to any mandatory law that applies, the courts of Alberta have exclusive jurisdiction over those disputes.
Changes and general provisions
We may update these Terms prospectively by posting a revised version and effective date. Continued use after an update means you accept the revised Terms. If any provision is held unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver.
